ACCEPTANCE OF TERMS

By accessing or using the Great Lakes Trade Academy, LLC (“Great Lakes Trade Academy,” “we,” “us,” or “our”) website, learning management system, virtual reality training environments, mobile applications, or any related services (collectively, the “Services”), you (“you,” “your,” or “Student”) agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you may not access or use our Services. Your enrollment in any Great Lakes Trade Academy program constitutes acceptance of these Terms along with your enrollment agreement.

DESCRIPTION OF SERVICES

Great Lakes Trade Academy provides online workforce training programs in technical fields including Appliance Repair, HVAC/R, and IT Support. Our Services include:

  • Online learning management systems with interactive course content

  • Virtual reality training environments for hands-on skill development

  • AI-powered teaching assistants and personalized learning support

  • Progress tracking, assessments, and certification preparation

  • Career services including resume development and job placement assistance

  • Student support services and technical assistance

ELIGIBILITY AND ENROLLMENT

Age Requirements
You must be at least 18 years of age to enroll in our programs or use our Services.
Educational Prerequisites
You must possess a high school diploma or equivalent (HiSET, GED, TASC, or other approved credential) to enroll in our training programs.
Account Registration
You must provide accurate, current, and complete information during registration and maintain the accuracy of your account information. You are responsible for safeguarding your login credentials and for all activities that occur under your account.

Geographic Limitations

Our Services are primarily designed for students within the United States. Access from other jurisdictions may be limited or restricted.

ACCEPTABLE USE POLICY

Permitted Uses

You may use our Services solely for educational purposes related to your enrollment in Great Lakes Trade Academy programs. Permitted activities include:

  • Accessing course materials and completing assignments

  • Participating in virtual training environments and simulations

  • Communicating with instructors, staff, and fellow students

  • Using career services and job placement resources

  • Accessing support services and technical assistance

Prohibited Activities
You may not use our Services to:
  • Violate any applicable laws, regulations, or third-party rights

  • Share, distribute, or reproduce copyrighted course materials without authorization

  • Share your login credentials or allow unauthorized access to your account

  • Engage in academic dishonesty, including cheating, plagiarism, or falsification

  • Upload or transmit viruses, malware, or other harmful code

  • Attempt to gain unauthorized access to our systems or other users’ accounts

  • Use automated tools or bots to access or interact with our Services

  • Interfere with or disrupt the operation of our Services

  • Use our Services for commercial purposes without written authorization

  • Reverse engineer, decompile, or attempt to extract source code from our platforms

  • Create derivative works based on our proprietary content or software

Virtual Training Environment Rules
When using virtual reality training environments, you must:
  • Follow all safety protocols and instructions provided

  • Use equipment responsibly and report any technical issues promptly

  • Complete training modules in the prescribed sequence

  • Maintain professional conduct during simulated workplace scenarios

  • Respect intellectual property rights in virtual training content

INTELLECTUAL PROPERTY RIGHTS

Our Content
All content provided through our Services, including but not limited to text, graphics, logos, images, audio clips, video clips, software, and course materials, is owned by Great Lakes Trade Academy or our content partners and is protected by copyright, trademark, and other intellectual property laws.
License to Use
We grant you a limited, non-exclusive, non-transferable license to access and use our Services and content solely for educational purposes during your enrollment. This license automatically terminates upon completion or termination of your program.
Student-Generated Content
By submitting content through our Services (such as assignments, forum posts, or project submissions), you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for educational and administrative purposes.
Third-Party Content
Our Services may include content licensed from third-party providers. Such content remains the property of the respective owners and is subject to their terms and conditions.

PRIVACY AND DATA COLLECTION

Information Collection
We collect personal information, educational records, and usage data as described in our Privacy Policy. By using our Services, you consent to the collection and use of information in accordance with our Privacy Policy.
Educational Records
We maintain educational records in compliance with the Family Educational Rights and Privacy Act (FERPA) and applicable state regulations. Students have specific rights regarding access to and control over their educational records.

PAYMENT TERMS AND REFUNDS

Tuition and Fees
Program costs are specified in your enrollment agreement and may include tuition, equipment fees, and certification exam fees. All fees must be paid according to the payment schedule outlined in your enrollment agreement.
Refund Policy

Refunds are governed by Massachusetts General Laws Chapter 255, Section 13K and are detailed in your enrollment agreement and our Student Handbook. Refund eligibility depends on the timing of withdrawal and program completion status.

Third-Party Payments

If using third-party financing or payment services, you are subject to their additional terms and conditions. We are not responsible for issues arising from third-party payment processing.

STUDENT CONDUCT AND ACADEMIC INTEGRITY

Code of Conduct
All students must adhere to our Student Code of Conduct, which includes:
  • Maintaining academic integrity in all coursework and assessments

  • Treating all community members with respect and professionalism

  • Following all program policies and procedures

  • Complying with applicable laws and regulations

Academic Dishonesty
Academic dishonesty, including but not limited to cheating, plagiarism, falsification of records, or unauthorized collaboration, may result in disciplinary action up to and including program dismissal.
Disciplinary Actions
Violations of these Terms or our policies may result in:
  • Warning or probation

  • Temporary suspension of access to Services

  • Permanent termination of enrollment

  • Legal action if warranted

DISCLAIMERS AND LIMITATIONS

Educational Outcomes
While we strive to provide high-quality education and career preparation, we do not guarantee:
  • Specific learning outcomes or skill acquisition

  • Successful completion of certification exams

  • Job placement or employment opportunities

  • Specific salary levels or career advancement

Technology Disclaimer
Our Services depend on various technology platforms and internet connectivity. We do not guarantee:
  • Uninterrupted access to our Services

  • Error-free operation of learning platforms

  • Compatibility with all devices or operating systems

  • Immediate resolution of technical issues

Third-Party Services
We integrate various third-party services for course delivery and student support. We are not responsible for:
  • Availability or performance of third-party platforms

  • Changes to third-party terms of service

  • Data practices of third-party providers

  • Technical issues arising from third-party services

WARRANTY DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
  • OUR SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS

  • OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE

  • THE RESULTS OBTAINED FROM OUR SERVICES WILL BE ACCURATE OR RELIABLE

  • ANY ERRORS IN OUR SERVICES WILL BE CORRECTED

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREAT LAKES TRADE ACADEMY , ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Great Lakes Trade Academy, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

  • Your use of our Services

  • Your violation of these Terms

  • Your violation of any rights of another party

  • Your violation of any applicable laws or regulations

TERMINATION

Termination by You
You may terminate your enrollment and discontinue use of our Services at any time by providing written notice as specified in your enrollment agreement. Refunds, if applicable, will be processed according to our refund policy.
Termination by Us
We may terminate or suspend your access to our Services immediately, without prior notice, if:
  • You violate these Terms or our policies

  • You engage in fraudulent or illegal activities

  • You fail to meet financial obligations

  • You fail to maintain satisfactory academic progress

  • We discontinue our Services or your program

Effect of Termination
Upon termination:
  • Your access to our Services will cease

  • You must return any loaned equipment

  • Certain provisions of these Terms will survive termination

  • We will retain your educational records as required by law

FORCE MAJEURE

We shall not be liable for any failure or delay in performance under these Terms that is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, network infrastructure failures, or other causes beyond our reasonable control.

MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes by:
  • Posting updated Terms on our website

  • Sending email notifications to enrolled students

  • Providing notice through our learning management system

Your continued use of our Services after the effective date of any changes constitutes acceptance of the modified Terms.

DISPUTE RESOLUTION

Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
Jurisdiction
Any disputes arising under these Terms shall be resolved in the state or federal courts located in Massachusetts, and you consent to the jurisdiction of such courts.
Informal Resolution
Before initiating any formal legal proceedings, you agree to first attempt to resolve disputes through our internal grievance procedure as outlined in our Student Handbook.
Limitation on Actions
Any claim or cause of action arising from or related to these Terms or our Services must be filed within one (1) year after the claim or cause of action arose, or it will be forever barred.

COMPLIANCE WITH LAWS

Educational Regulations
Our Services are subject to various federal and state educational regulations, including but not limited to requirements from the Massachusetts Division of Professional Licensure.
Export Controls
Our Services may be subject to U.S. export control laws. You agree not to export, re-export, or transfer any content or technology in violation of applicable laws.
Accessibility
We strive to make our Services accessible to individuals with disabilities in accordance with the Americans with Disabilities Act (ADA) and other applicable accessibility laws.

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

ENTIRE AGREEMENT

These Terms, together with your enrollment agreement, our Privacy Policy, and Student Handbook, constitute the entire agreement between you and Great Lakes Trade Academy regarding our Services and supersede all prior agreements and understandings.
